GSK Stockmann advises BMW Group on construction law in Lower Bavaria

GSK Stockmann has advised the BWM Group on obtaining planning permission for its new assembly site for high-voltage batteries in Irlbach and Strasskirchen, Lower Bavaria.

The new site is located in the municipalities of Strasskirchen and Irlbach, around 40 km north-east of Europe’s largest BMW automotive plant in Dingolfing. For the project, the two municipalities joined together to form a planning association. They approved the development plan on 10 April 2024. This announcement in the official gazette of the Straubing-Bogen district constitutes the legal basis for BMW’s construction of the new site. The early start for soil removal construction site set-up and the installation of construction and office containers was approved at the end of March. In the meantime, construction is advancing quickly.

The assembly site will supply the BMW Group’s Bavarian automotive plants in Munich, Dingolfing and Regensburg with next-generation high-voltage batteries, creating new jobs in the region.

GSK Stockmann comprehensively advised the BMW Group with a team led by Munich partner Dr Wolfgang Würfel on obtaining the planning permission. Together with the BMW Group, the team was able to achieve an effective development plan for an area of 134 hectares in less than a year on 18 April 2024, an enormous success given the size and complexity of the project, the parallel regional planning procedure and a public petition.

Advisers of BMW Group:

Dr Wolfgang Würfel (lead, project development), Ludwig Schnur (environmental, planning, municipal and development law), Timo Aust (emission protection law), Dr Phyllis Simsch (property and land register law), Franziska Pompejus (conservation law), Konstantin Kerschensteiner (environmental and planning law), Dominik Berka (tax)

Legal department at BMW: Dr Susanne Haggenmiller, Florian Kling LL.M. (UWC)
