On 13 December 2023, the European Commission published a new De Minimis Regulation and a new SGEI De Minimis Regulation. Both regulations are coming into force on 1 January 2024, replacing the previous de minimis regulations. The new regulations contain two important changes: Firstly, the amounts of aid that a company can receive as de minimis aid will be increased significantly by 50%. In future, up to EUR 300,000 can be granted as de minimis aid over three years, and EUR 750,000 can be granted as SGEI de minimis aid over three years. Secondly, the Member States will be required to keep a central register recording all de minimis aid and SGEI de minimis aid granted and its beneficiaries from 1 January 2026 on. This GSK Update provides an overview of all the rules set by the two new regulations.
