EU Digital Services Act comes into force

The Digital Services Act has just come into force, harmonising the obligations of online service providers across the EU. This is intended to not only guarantee legal certainty for providers and strengthen the rights of users, but also to counteract the risks such services pose to society. However, the DSA does not introduce any stricter rules regarding the liability of intermediary services. Extensive reporting obligations for intermediary services and new enforcement options round off the catalogue of measures. The Member State authorities are equipped with extensive rights to information, to conduct searches, to issue orders and to impose sanctions; they are also authorised to impose fines of up to 6% of the intermediary service’s annual worldwide turnover.
